1. Acceptance of the general conditions of sale

1.1 The contract stipulated between Arte dal Mondo S.r.l. and the Customer shall be considered concluded with the acceptance, even if only partial, of the order by Arte dal Mondo S.r.l. This acceptance is considered tacit, unless otherwise communicated in any way to the customer. By placing an order in the various ways provided, the customer declares to have read all the information provided to him during the purchase process, and to accept in full the general conditions and payment transcribed below.

1.2. If the Customer is a consumer, once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Legislative Decree 21/2014 "Consumer Code".

1.3. It excludes any right of the customer to compensation or damages, as well as any contractual or non-contractual liability for direct or indirect damages to persons and / or property, caused by the non-acceptance, even partial, of an order.

1.4 For orders placed from a reseller account, the following are also considered accepted ADM sales conditions for resellers.

 

2. Methods of purchase

2.1 The customer can only buy products present and available in the electronic catalog of Arte dal Mondo S.r.l. at the time of placing the order and viewable online at (URL) www.artedalmondo.eu.

2.2 It is understood that the picture accompanying the description sheet for a product may not perfectly represent its characteristics, there may be differences in color, size, and the accessory products in the picture. The presentation of each product on the site is for illustrative purposes only and does not constitute a representation or warranty by Arte dal Mondo S.r.l. as to the actual characteristics and performance of the goods sold.

2.3 The correct receipt of the order is confirmed by Arte dal Mondo S.r.l. through a reply via e-mail, sent to the e-mail address communicated by the customer. The message re-proposes all the data entered by the customer who undertakes to verify the correctness and to communicate any corrections promptly, in the manner described in this document.

2.4 Arte dal Mondo S.r.l. reserves the right not to process purchase orders or entries that do not give sufficient guarantees of solvency or that are incomplete or incorrect, or in case of unavailability of products.

2.5 In case of non-acceptance of the order, Arte dal Mondo S.r.l. guarantees timely communication to the customer.

 

3. Methods of payment

Arte dal Mondo S.r.l. offers the following methods of payment:

3.1 Credit card / Paypal

In the case of a purchase of goods with Credit Card payment or Paypal, simultaneously with the completion of the on-line transaction, the reference bank will authorize only the amount due for the purchase performed.

3.1.1 In case of order cancellation, whether on request of the Client or in case of non-acceptance of the order by Arte dal Mondo S.r.l., Arte dal Mondo will request the cancellation of the transaction and the release of the amount due. The release time depends exclusively by banking system. After the transaction has been cancelled, under no circumstance Arte dal Mondo S.r.l. may be held liable for any damages, direct or indirect, caused by a delay in the release of the amount by banking system.

3.1.2 Under no circumstance during the purchase procedure  Arte dal Mondo S.r.l. will have access to the credit card information of the buyer. No IT archive of Arte dal Mondo S.r.l. will store such data. Therefore, under no circumstance Arte dal Mondo S.r.l. may be held responsible for any fraudulent or improper use of credit cards by third parties when paying for products purchased on its website www.artedalmondo.eu.

3.2 Bank transfer

In case of payment by advance bank or postal wire transfer, Arte dal Mondo S.r.l. will keep the material ordered in stock for a period not exceeding 10 business days from the date of the order, after which it reserves the right to terminate the agreement.

3.2.1 If the payment is received after termination of the agreement by Arte dal Mondo S.r.l., the latter reserves the right not to process the order and to reimburse the client the amount already paid after deducting all the expenses incurred by it. The refund will be issued via bank wire transfer within 14 days from receipt of payment. It will be the client's responsibility to promptly provide the bank coordinate details on which to obtain the refund (ABI - CAB Code - Current account of the invoice holder or IBAN BIC and current account of the holder if the client does not reside in Italy).

The bank wire transfer shall specify:

  • the reference number of the order;
  • the date on which the order was placed;
  • First and last name of the person who placed the order.

Arte dal Mondo S.r.l. will send the material ordered only after the payment is credited on the account.

3.3 Instalment Payment - Paypal

Arte dal Mondo S.r.l. offers PayPal's "Pay in 3 instalments" instalment option, with no interest and no admin fees. By choosing this option, Customers can easily pay for their purchases in 3 instalments spread over two months and view and manage the instalment due dates through the PayPal app. It is also possible to pay in advance, at no additional cost. 'Pay in 3 instalments' is available for eligible purchases from €30 to €2000.
Once this payment method is selected, the customer is directed to the PayPal account where they will see a "Pay in 3 installments" option, available if the customer is deemed eligible by PayPal. If so, the customer can apply for payment by instalments in a few steps, receiving quick feedback to complete the purchase.

3.3.1 In case of order cancellation, whether at the request of the customer or in case of non-acceptance of the order by Arte dal Mondo S.r.l., Arte dal Mondo will request cancellation of the transaction and the release of the amount due. The release time depends exclusively on the bank in question. After the transaction has been cancelled, under no circumstance may Arte dal Mondo S.r.l. be held liable for any damages, whether direct or indirect, caused by a delay in the release of the amount by the bank.

 

4. Shipping

4.1 Delivery method and times

The standard service used for shipping in Italy is via express carrier (delivery in 1-3 business days). Also in all countries of the European Union, except some islands and remote areas, shipping is via express carrier (delivery in 2-5 business days). For shipping to any other countries, availability, time and cost must be quoted on a case-by-case basis.

4.1.1 All types of shipping mentioned above offer the possibility to track the shipping on-line.

4.1.2 Deliveries are made from Monday to Friday during normal business hours, excluding national holidays.

4.1.3 The products ordered can be delivered to the address specified by the Client on the order form.

4.1.4 No liability can be attributed to Arte dal Mondo S.r.l. in case of delay in the execution of the order or in the delivery of what was ordered.

4.1.5 The delivery of goods is understood as roadside. If you need the delivery to the floor you must specifically specify this when ordering (in the notes and by email) to check availability and additional costs for this service.

4.2 Transfer of risk and shipping damage

At the time of delivery of the goods by the carrier the Client is required to check:

  • that the packaging is intact, not damaged, not wet or otherwise altered. This applies also to the sealing materials (adhesive tape or metal straps);
  • that the material delivered corresponds to what was ordered.

Pursuant to art. 63 of the Consumer Code, any damage to the product packaging must be immediately notified by you in writing on the delivery documents. It is understood that, once you have signed the delivery document without notifying of any abnormal conditions, this means that you accept the external characteristics of the material delivered.

Any damage to the delivered product attributable to shipping, or non-delivery, must be reported within 5 days from the delivery date shown on the tracking of the package, in writing, to [email protected], as described in the paragraph below. In the event that the customer fails to fulfill these duties within the time limits described herein, there will be no entitlement to compensation. 

For customers enrolled in the ADM Club, Arte dal Mondo S.r.l. offers an extended verification period of up to 10 days from the delivery date indicated on the tracking. 

4.2.1 How to proceed in case of shipping damage

The Customer shall send the following to [email protected] according to the above time limits: 

  • A precise description of the problem and a more detailed description of the product damage(s) accompanied by detailed photos of both the damage and the product in its entirety.
  • Photos of the packaging at the time of delivery with the item number printed on the cartons visible.
  • A photo/scan of the proof of delivery, signed by the courier and the Customer (marked as damaged and/or awaiting inspection).
  • The desired outcome for issue resolution, for example, repair, replacement of the product, sending a replacement part, partial refund or return and full refund.

The original packaging must be kept by the customer in case of any claims.

4.2.2 In the event that the carrier was chosen by you and that is a carrier not listed among the ones proposed at the time of purchase, the risk of damage and loss of the Products is transferred to you when the product is delivered to the carrier. Therefore, you waive the right to any claim regarding the external characteristics of the goods delivered. In this case, any claim must be filed directly by you to the carrier.

4.2.3 Storage at the courier company

In the event of failure to collect within 5 business days the material  stored at the warehouses of the carrier due to repeated inability to deliver to the address specified by the Client at the time of order, and in all cases where the goods cannot be delivered to the Client for reasons not attributable to mistakes or omissions by Arte dal Mondo S.r.l. or the carrier to which the goods were entrusted, the order will be automatically cancelled and Arte dal Mondo S.r.l. will reimburse the Client the amount paid less the amount of all expenses incurred up to that time.

4.3 Delivery costs

Arte dal Mondo S.r.l. offers ADM Club members free shipping on orders to all European Union countries - excluding for orders placed from Retailer accounts.

If the country of destination of the shipment is outside the European Union, the shipping costs and any additional costs for customs clearance are borne by the customer, as it is not possible for this latter to predict the amount and therefore the charge when creating the order.

4.3.1 The shipping costs specified on the www.artedalmondo.it website are only indicative and not binding for Arte dal Mondo S.r.l.

Arte dal Mondo S.r.l. undertakes to promptly inform the client if it is necessary to increase the shipping costs specified at the time of order confirmation (this applies in particular to goods sent to foreign islands, remote locations and historical centres).

 

5. Right of Withdrawal

Pursuant to Legislative Decree 21/2014 the "Consumer Code", if the client is a consumer (that is a natural person who buys goods for purposes not attributable to his/her professional activity, or does not specify the VAT number at the time of purchase when filling out the order form of Arte dal Mondo S.r.l.), he/she has the right to withdraw from the purchase agreement for any reason, without explanation and without penalty, except as indicated in paragraphs 5.3 and 5.4 shown below.

The Client has a period of 14 (fourteen) days to withdraw from the agreement.

It is not permitted to change a model for another. To exchange one item for another, it will need to be returned for refund and a new purchase made.

5.1 Procedure

To exercise this right, the client shall fill in the electronic form and ask for the Return Authorization Number (RMA) that will identify the file.

Once we receive the aforementioned notice of withdrawal, the Customer Service of Arte dal Mondo S.r.l. will quickly notify to the client the instructions on how to return the goods. The client is required to return the goods or deliver them to us without undue delay and in any case within 14 days from the day in which the withdrawal from this agreement has been notified.

Arte dal Mondo S.r.l. will refund to the client all payments issued, including delivery costs (except for additional costs arising from your choice of a type of delivery different from the least expensive one that we offer), without undue delay and in any case no later than 14 days from the day we are informed of your decision to withdraw from this agreement. The refund could be withheld beyond 14 days only until you prove that you returned the goods or until they are received by us, depending on which situation occurs first.

5.2 Refund procedure

The refund will be issued:

  • for purchases made by credit card or Paypal through a re-crediting to the client's account;
  • for purchases made through bank wire transfer via bank wire transfer to the client's account. It will be the client's responsibility to promptly provide the bank coordinate details on which to credit the refund (ABI - CAB Code - Current account of the invoice holder or IBAN BIC and current account of the holder if the client does not reside in Italy).

5.3 Conditions for returns

The right of withdrawal is subjected to the following conditions:

  • The right of withdrawal does not apply to products expressly made on the client’s specification or design, or to products that are changed or assembled along with others on client request;
  • the item purchased must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment) to limit damage to the original package, we recommend, when possible, to put it in an additional box;
  • in accordance with the law, the shipping costs related to the return of the goods are borne by the client. If the client agrees to entrust the shipment to Arte dal Mondo S.r.l. the latter will communicate the amount of the expenses upon acceptance of the return. Shipping costs change and depend on the size of the items;
  • upon arrival at our warehouse, the product will be examined to check for any damage or tampering not resulting from transport. Therefore, you are only responsible for a reduced value of the goods resulting from the handling of the goods other than the one necessary to establish the nature, characteristics and functioning of the goods.

5.4 Forfeiture of right

The right of withdrawal is void, for lack of the essential condition of integrity of the goods (packaging and/or its contents), in those cases where Arte dal Mondo Srl ascertains:

  • the absence of the external packaging and/or the original  internal packaging;
  • the absence of the integral elements of the product;
  • the damage to the product for reasons other than transport.

If the withdrawal right is void, Arte dal Mondo S.r.l. shall return the good purchased to the sender, upon payment of the shipping costs by the latter.

5.5 Return extended to 365 days

Members of the ADM club have a right of return extended to 365 days, subject to all the conditions described above.

 

6. Warranty

All products sold by Arte dal Mondo S.r.l. are covered by the official manufacturer's warranty with a minimum validity of 24 months for the consumer (a natural person who buys goods for purposes not attributable to his/her professional activity, or does not specify the VAT number at the time of purchase when filling out the order form of Arte dal Mondo S.r.l.). The warranty shall be 12 months for purchases made by companies or for professional purposes.

The warranty applies to products with defects and/or malfunctions not identified at the time of purchase, provided that the product is used correctly and with due diligence, that is in compliance with its intended use and as provided for in any technical documentation. The warranty does not cover any damage resulting from heavy-duty commercial use.

The warranty does not apply in case of discrepancy with the picture accompanying the descriptive sheet of a product. The fact that our products are made by hand makes them unique and equal only to themselves; in addition, the colors in the photographic image may vary depending on the type of light used in the studio (warm light/cold light/distance between the product and the surrounding lighting), the type of camera used, and the type of device (monitor) on which it is displayed. In fact, the colors in the product photos may vary slightly from the actual colors seen by our eyes, due to the use of electronic screens with parameters in the different devices used by Customers.
However, we do our best to present the product as realistically as possible and recommend looking at the same photo on multiple devices to get as accurate an idea as possible of the "real" color. The dimensions of some products may also vary slightly from piece to piece from those shown on the website with a margin of error of +/- 5 cm.

6.1 Repairs

Any repairs during the warranty period are guaranteed by Arte dal Mondo S.r.l. at its headquarters.

The transportation costs related to the shipment for repair and return of the repaired product are borne by Arte dal Mondo

If, for any reason, Arte dal Mondo S.r.l. is unable to return a product under warranty (repaired or replaced) to its customer, it will refund the full amount paid or replace it with a product of equal or superior characteristics.

No damages may be claimed against Arte dal Mondo S.r.l. for any delays in carrying out repairs or replacements.

In all cases, the goods to be repaired or replaced must be returned by the customer in their original packaging, complete in all their parts (including packaging and any documentation and ancillary equipment); to limit damage to the original packaging, we recommend, when possible, to insert it in an additional box.

6.2 Certificates of craftsmanship

Arte dal Mondo S.r.l. usually offers, for some of its products, certifications of authenticity as stated in the online descriptions of the products. These certifications are called for simplicity "Warranty Certificate" but have nothing to do with the warranty regarding operation or integrity of the product. These certifications are for the private use of the buyer and do not commit in any way Arte dal Mondo S.r.l. to third parties. No damages may be claimed against Arte dal Mondo S.r.l. for any other use of these certifications.

 

7. Claims - Resolution of disputes

Any claim must be sent in writing to Arte dal Mondo S.r.l. - Via Colombo 223 Gorla Minore (VA) 21055 Italy.

Consumers in Europe are informed that the European Commission has set up an online platform that provides an alternative dispute resolution tool.

This tool may be used by European Consumers to resolve in an out of court manner any dispute relating to contracts for the sale of goods and services entered into online and/or arising from the same.

Consequently, if you are a Consumer established in Europe, you can use this platform for the resolution of any dispute arising from the online agreement entered into on this website.

8. Applicable law

The sales agreement between the Customer and Arte dal Mondo S.r.l. is entered into in Italy and regulated by Italian law. For the resolution of civil and criminal disputes arising from this remote sale agreement, the jurisdiction is that of the Court of Milan in the case of a Merchant Customer, or Customer making purchases using a VAT number, while in the case of Customers purchasing goods as Private Consumers the Court of jurisdiction will be the one at the place of residence or domicile of the Customer.
