Arte dal Mondo S.r.l. processes the personal data of its visitors and customers in compliance with the relevant national and European legislation, in particular Regulation (EU) 2016/679 (hereinafter 'GDPR').

The information on this page, provided pursuant to Art. 13 of the GDPR, exclusively concerns the artedalmondo.eu website and not to other third-party websites or online services that can be reached by visitors via hypertext links that may be published on this website.

2. Purpose and legal basis of processing

The data collected are processed, depending on the visitor's activity, for the following purposes and in accordance with the legal bases indicated here:

A. to manage information requests submitted by visitors by e-mail; to manage requests for notice of availability of articles on the site (art. 6, par. 1(b) of the GDPR - execution of pre-contractual measures taken at the request of the Data Subject);

B. to handle orders for goods purchased by the visitor, including dispatch and e-mail updates on the status of orders, according to the instructions given by the purchaser (Art. 6, par. 1(b) of the GDPR - performance of a contract to which the data subject is party);

C. to manage order payments and related invoicing (Art. 6, par. 1(b) and (c) of the GDPR - performance of a contract to which the data subject is party, as well as performance of legal obligations to which the Data Controller is subject);

D. to allow the user to create their own personal account on the site in order to keep track of the history of their orders and any returns, to register their own wishlist, to easily manage their consent to the Arte Dal Mondo newsletter, as well as to have rapid access to their personal data processed by the Controller and to be able to complete any orders more quickly (art. 6, par. 1(b) of the GDPR - performance of a contract to which the data subject is party);

E. to send review requests through dedicated companies. For this purpose, the legal basis corresponds to the legitimate interest of the Controller, pursuant to Art. 6, par. 1(f) of the GDPR, respecting the rights and freedoms of natural persons and taking into account the reasonable expectations of the data subject;

F. only with the express consent of the user, pursuant to Art. 6, par. 1(a) of the GDPR, for the sending of promotional communications by the Data Controller; where the Data Subject freely decides to also indicate their date of birth and/or gender, such data will be used exclusively for the sending of promotions also related to the period of their birthday or special occasions (e.g. Women's Day, Mother's Day...);

G. if they are already our customer and unless they object (this right may be exercised at any time), to send: customer satisfaction requests in relation to purchasing experiences; commercial and/or promotional communications to the e-mail address provided in relation to the Controller's products/services similar to those already used. For these purposes, the legal basis corresponds to the legitimate interest of the holder, while respecting the rights and freedoms of the persons concerned, pursuant to Art. 6 Art. 1(f);

H. to enable the proper functioning of the site, including ensuring its security by preventing possible cyber attacks or unlawful use thereof. For this purpose, the legal basis corresponds to the legitimate interest of the holder, while respecting the rights and freedoms of the data subjects, pursuant to Art. 6 Art. 1,(f).

 

3 Retention period

For the purposes of point A., the data will be deleted within 3 years of the last e-mail exchanged with the user.

For the purposes of points B. and C., data relating to orders and invoices are stored for a maximum period of 10 years from the date of issue of the invoice.

For the purpose of point D., the user's data are deleted 3 years after the last access, at any time, at the request of the data subject. In any case, deletion of the account does not entail deletion of the data processed by the Controller for the other purposes.

For the purpose of point E., data will be processed for 3 years after the last access.

For the purpose referred to under F., the subscription to the newsletter has a duration of ten years, except in the case of prior revocation of consent by the user; in the latter case, it may take a few days for the deletion of the e-mail address from the database to become definitive and the user will no longer receive communications from Arte Dal Mondo.

For the purpose referred to under G., the data will be processed for a period of 3 years from the last access, except in the case of prior revocation of consent by the user; in the latter case, it may take a few days for the deletion of the e-mail address from the database to become definitive and the user will no longer receive any communication from Arte Dal Mondo.

4 Nature of data provision

The forms on the site (contact, registration or to place an order) have certain fields marked with an asterisk (*): the provision of personal data with reference to these fields is necessary, while it is optional for all other fields. Failure to provide the necessary data will make it impossible for the visitor, as the case may be, to submit their request by form, to complete their registration on the site, or to proceed with the purchase of the desired products.

The provision of optional data is useful for the purpose of statistical analysis from the customer base (referred to in purpose G) and, with reference to the newsletter subscription form (purpose F), in order to be able to receive promotions dedicated to those having a birthday and/or reserved for women during their celebration period.

 

5 Third parties processing data

The Controller makes use of its own 'Data Processors', i.e. external parties (companies or professionals) who process data on behalf of the Controller, pursuant to Art. 28 of the GDPR.

The Data Processors may process personal data of which they become aware solely for the purpose of carrying out the tasks assigned to them by the Data Controller. In the case of Arte Dal Mondo, these subjects are:

  • Companies that maintain the technological part of the site and the management software;
  • IT services company for the management of e-mail communications.
  • Social/google for browsing data

 

6 Browsing data and cookies

The computer systems and software procedures used for the routine operation of this site acquire certain personal data, the transmission of which is implicit in the use of Internet communication protocols. This category of data includes the IP addresses or domain names of the computers and terminals used by users, the URI/URL (Uniform Resource Identifier/Locator) notation addresses of the resources requested, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user's operating system and computer environment. Except as stated in the cookie policy of this site [https://www.artedalmondo.eu/it/cookies/], there is no retention of browsing data.

 

7 Rights of data subjects

The GDPR grants all Data Subjects several rights, which they can exercise by contacting the Data Controller at the contact details given in point 1) of this notice (it is suggested to indicate in the subject line of emails: “EXERCISE OF PRIVACY RIGHTS”).

Among the rights that may be exercised, provided that the prerequisites laid down in the legislation (in particular, Art. 15 et seq. of the GDPR) are:

- the right to know whether the Controller is processing personal data concerning the data subject;

- the right for the data subject to have access to their own data being processed and to all information relating thereto;

- the right to have inaccurate personal data concerning the data subject corrected and/or incomplete personal data supplemented;

- the right to the deletion of the data subject's personal data;

- the right to restriction of the processing of the data subject's personal data;

- the right to object to the processing of the data subject's personal data;

- the right to the portability of the data subject's personal data;

- the right to revoke at any time any consent previously given, with the caveat that the revocation is not retroactive and that, therefore, it does not affect the lawfulness of the processing previously carried out on the basis of the consent.

In any event, each data subject also has the right to lodge a formal complaint with the Italian Data Protection Authority, according to the modalities available on the institutional website of that Authority: https://www.garanteprivacy.it.
